Notice of Hearing
The Kansas Department of Insurance will hold a public hearing on the Farmers Alliance Mutual Insurance Company Plan of Reorganization and Mutual Holding Company Conversion (“Plan”) pursuant to K.S.A. 40-4004 and 77-501 et seq. The Assistant Commissioner of Insurance will act on behalf of the Commissioner of Insurance as agency head and is empowered to render a final order. K.S.A. 77-526(a) and K.S.A. 77-547. The hearing will be held from 9:00 a.m. to 12:00 p.m. (Central Time) Friday, April 10, 2026, at the Kansas Department of Insurance, 1300 SW Arrowhead Rd., Topeka, KS 66604, and online through Microsoft Teams, as described below.
Under K.S.A. 44-4004, the Commissioner shall approve the Plan if she finds that: (1) the plan of conversion is fair and equitable to policyholders, (2) the plan of conversion complies with the provisions of the conversion act; (3) the plan of conversion does not unjustly enrich any director, officer, agent or employee of the insurer; and (4) the new stock insurer would meet minimum requirements to be issued a certificate of authority by the Commissioner to transact business in this state and the continued operations of the new stock insurer would not be hazardous to existing or future policyholders or the public.
Subject to K.S.A. 77-523(c) any interested person who is not a party may make oral or written statements or comments upon the proposed conversion at the hearing to be included in the formal record of the proceedings. While all those who wish to testify may do so, the Commissioner may, in order to accommodate all interested persons, limit the time that any individual or group may speak.
To accommodate interested persons and maximize the opportunity for interested persons to participate, any person wishing to testify in-person or remotely over Teams should register with the Commissioner by emailing to kdoi.publiccomment@ks.gov. Written statements, under oath, may also be sent to the Commissioner if an interested person is unable to or does not wish to attend the public hearing. Persons interested in submitting a written statement should contact: Assistant General Counsel, Philip Michael at philip.michael@ks.gov. All written statements must be received before the close of the public hearing in order for the statement to be included in the public hearing record.
Any individual with a disability may request accommodation in order to participate in the public hearing in person or remotely. The west entrance to the Department of Insurance is accessible. Accessible parking is located on the west side of the Department.
