Notice of Water Quality Certification

The Kansas Department of Health and Environment (KDHE) has drafted a water quality certification per Section 401 of the Clean Water Act (CWA) requested by Kari Bigham of Meander Engineers, LLC for Landoll Properties, LLC. The United States Army Corps of Engineers USACE) CWA Section 404 Public Notice No. NWK-2025-00561 can be found at https://www.nwk.usace.army.mil/Media/Public-Notices. The purpose of the project is to reduce streambank erosion along 1,340 feet of the left, descending bank of the Kansas River in Pottawatomie County to protect private property. Installation will include: 5 bendway weirs ranging from 3 to 5 feet tall and 40 to 70 feet long, as well as 695 feet of 4-foot-tall Longitudinal Peaked Stone-Toe Protection (LPSTP), all made from limestone rock. The project also plans to remove and reuse 45 cubic yards of rock dumped previously into the river, and regrading of the bank to a 3H:1V slope. Site conditions during construction will be existing cropland and timber, and the project will be installed in the winter months. Riparian treatment includes planting of a mixture of native grass, trees, and shrubs.

The draft certification and additional information containing the link to the USACE Public Notice is posted on the KDHE website at https://www.kdhe.ks.gov/1095/Section-401-Water-Quality-Certification. Persons wishing to comment on the referenced draft document must submit their comments in writing by email to the Kansas Department of Health and Environment at KDHE.NPS@ks.gov by November 23, 2025, if they wish to have their comments considered in the formulation of final determinations for 401 regarding this public notice.
