Notice of Water Quality Certification

The Kansas Department of Health and Environment (KDHE) has drafted a water quality certification per Section 401 of the Clean Water Act (CWA) requested by Ms. Kari Bigham, Meander Engineers LLC for Stephen and Teresa Hammett. US Army Corps of Engineers (USACE) CWA Section 404 Public Notice No. NWK-2025-00480 found at https://www.nwk.usace.army.mil/Media/Public-Notices. The purpose of the project is to reduce streambank erosion along 2,600 feet of the left, descending bank of the Big Blue River to reduce downstream sedimentation in Tuttle Creek Reservoir. The applicant proposes the removal of 18,500 cubic yards of previously installed concreate hard points to reduce an unnatural pinch point. Installation will include 1,500 feet of 6-foot tall Longitudinal Peaked Stone-Toe Protection (LPSTP) made from limestone rock, 700 feet of 3-foot tall LPSTP, 150 feet of 2-foot tall LPSTP, and 16 bendway weirs (limestone rock, 2-7 foot tall). Following installation of the rock structures, 1,975 feet of the bank will be regraded to form a floodplain bench (approximately 4-6 feet high) over the 6-feet tall LPSTP and a 3H:1V slope above the bench to existing top of bank elevation (additional 12 feet). In addition, 700 ft of the bank will be shaped to a 3H:1V slope (approximately 16 feet high) above the LPSTP. The floodplain bench, graded bank, and disturbed riparian area (approximately 4 acres) will be planted with a mixture of native grass, trees, and shrubs all in Marshall County.

The draft certification and additional information containing the link to the USACE Public Notice will be posted on the KDHE website at https://www.kdhe.ks.gov/1095/Section-401-Water-Quality-Certification on or before August 21, 2025. Persons wishing to comment on the referenced draft document must submit their comments in writing by email to the Kansas Department of Health and Environment at KDHE.NPS@ks.gov by September 21, 2025, if they wish to have their comments considered in the formulation of final determinations for 401 regarding this public notice.
